Overrun/Underrun
The total amount of manufactured product is subject to +/- 10% over/underrun. Your final invoice will be adjusted accordingly.
Shipping
All freight/shipping and additional insurance costs are the responsibility of the customer. Blue Sky is available to assist the customer in arranging shipment of final product, however Blue Sky is not responsible for delivery delays, loss of product or damages incurred during the shipping process (that becomes the responsibility of the shipper). The customer MUST supply Blue Sky with all relevant shipping instructions, including additional insurance requirements, upon order submission.
Payment
With the exception of credit orders, a deposit of 50% of the initial invoice must be paid and funds cleared PRIOR to order commencement. Business and personal cheques are not accepted unless bank certified. The balance of the final invoice must be paid in full and funds cleared BEFORE any product is shipped to the customer or made available for pickup. Incorporated businesses may apply for credit. Please allow 5 business days for credit approval. Credit verification is required prior to order commencement.
Cancellation
Cancellation of any order while in progress is strictly prohibited. If, for any reason, an order is cancelled while in progress, the customer is liable for the total invoiced amount of the order, regardless of order completion. This is a necessary measure inherent in the manufacture of custom-built product such as music and multimedia.
Proprietary Rights
All source masters, printing film/proofs, and printed graphics/packaging provided by the customer remain the property of the customer. Standard practice is to retain these items on file at Blue Sky or its supplier to expedite reorder turnaround times. The return of such material(s) requires written authorization by the client. Please allow for 2-3 weeks for shipping of said materials.
Turnaround
Blue Sky Media Duplication enjoys unsurpassed turnaround time in the industry! However, turnaround times are subject to change for a variety of reasons. Blue Sky will endeavor to inform the customer at all times of changes in turnaround beyond its control. As such, customers should be prudent in establishing realistic product release dates to account for unforeseen delays in product fulfillment. Please notify your Blue Sky representative of any planned/tentative product release dates during the quoting process and specifically at the time of order submission.
Source Masters
It is the exclusive responsibility of the customer to ensure that all source masters and order materials meet Blue Sky specs and are free from any defect or blemish. If Blue Sky or its suppliers identify any defects in any source master or order materials, the customer will be notified and the order will be placed 'on hold' until a satisfactory remedy is found and supplied by the customer. Customer sign-off on proofs is required prior to order submission and is binding on the customer.
Guarantee
Blue Sky guarantees the satisfactory duplication/replication of source master materials provided. In the case of manufacturer's defect, a sample of the defective product must be returned to Blue Sky within 30 days of receipt. Blue Sky and its suppliers must verify the defect. Upon verification by Blue Sky and/or its suppliers, a replacement order (RA) number will be assigned and a FULL return of the defective product to Blue Sky and/or its supplier will be required prior to replacement order commencement. Replacement of defective product is subject to the same time constraints as the initial order. Blue Sky's liability is limited to replacement of or refund for defective product.
Intellectual Property
To legally manufacture music and multimedia product supplied by the customer, Blue Sky requires the following information:
(1) Label Copy: A production master sheet detailing: 1) the artist, 2) the title, 3) the catalogue number, and 4) a complete track listing, including song titles and song times.
(2) The name, address, and phone number of the artist/company (customer) commissioning the manufacture of music and/or multimedia by Blue Sky.
(3) A customer-signed Terms & Conditions/Copyright Declaration form pertaining to all materials supplied to blue Sky for reproduction (duplication, replication, printing etc.).
Licensing rights
All intellectual property rights of material supplied to Blue Sky for manufacturing (duplication, replication, printing, etc.) must be secured by the client prior to order commencement. These rights include but are not limited to songs. In the case of songs including sampled audio, this material must be licensed by the Canadian Musical Reproduction Rights Agency Ltd. (CMRRA) or pertinent licensing agency that holds and issues the licensing rights of the song(s). Blue Sky will require complete documentation of these licenses before as a prerequisite to order commencement.
